Cancellation: Terms and conditions WAIVER OF LIABILITY AND RELEASE AGREEMENT THIS IS A LEGAL DOCUMENT. PLEASE READ CAREFULLY BEFORE SIGNING. This Waiver of Liability and Release Agreement (the "Agreement") is entered into between the undersigned passenger ("Passenger") and View Rockies Charters ("Company"), for participation in the Company’s tour service (the "Service"). 1. ASSUMPTION OF RISK 1.1. Passenger acknowledges and understands that travel by a automobile involves inherent risks, including but not limited to accidents, personal injury, property damage, delays, and unforeseen circumstances such as adverse weather, road conditions, or mechanical failures. 1.2. Passenger voluntarily assumes all risks associated with the use of the Service, including those arising from the actions or inactions of third parties. 2. RELEASE OF LIABILITY 2.1. To the fullest extent permitted by Canadian law, Passenger hereby releases, waives, and discharges the Company, its directors, officers, employees, agents, affiliates, and contractors from any and all claims, liabilities, demands, actions, or causes of action arising from or related to participation in the Service, except in cases of gross negligence or willful misconduct by the Company. 3. LIMITATION OF LIABILITY 3.1. The Company shall not be responsible for any indirect, incidental, or consequential damages resulting from delays, cancellations, or any other disruptions to the Service. 3.2. The Company’s total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the amount paid by the Passenger for the Service. 4. PASSENGER RESPONSIBILITIES 4.1. Passenger agrees to comply with all Company policies, safety regulations, and instructions given by Company representatives. 4.2. Passenger is responsible for securing personal belongings and understands that the Company is not liable for lost, stolen, or damaged property. 5. INDEMNIFICATION 5.1. Passenger agrees to indemnify and hold harmless the Company from any claims, damages, or expenses (including legal fees) arising from Passenger’s actions, misconduct, or violation of this Agreement. 6. GOVERNING LAW 6.1. This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada. 6.2. Any disputes arising from this Agreement shall be resolved exclusively in the courts of Alberta. 7. SEVERABILITY 7.1. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 8. ACKNOWLEDGEMENT AND AGREEMENT 8.1. Passenger acknowledges that they have read and understood this Agreement and agree to its terms voluntarily and without coercion. 8.2. Passenger confirms that they are of legal age and have the authority to enter into this Agreement. 9. SCOPE OF SERVICE 9.1. The Company provides transportation services to the specified destinations only. The Company does not organize, operate, or assume responsibility for any third-party activities, excursions, attractions, or events that passengers may choose to participate in at the destination. 9.2. Passengers acknowledge that participation in any such activities is entirely voluntary and at their own risk. The Company bears no liability for injury, loss, or damage arising from or in connection with such third-party experiences.
